Impulse Internet Services - Terms of Service (TOS)

Impulse Internet Services (IIS) is an Internet Service Provider that manages a wide area telecommunications network (WAN). Customer wishes to connect his/her computer and/or network to IIS's local area network (LAN) via a dial-up and/or dedicated connection to establish an Internet presence via IIS's WAN. In return, Customer agrees to pay the monthly fees as established in the IIS Pricing Guide and according to the IIS Billing Policies.

IIS will NOT be responsible for any telephone charges that you may incur when calling our service. It is your responsibility to ensure that the telephone number you choose is NOT a toll number. If unsure of what number to choose, please call your telephone company or contact us.

Customer represents that he is at least eighteen years of age and accepts responsibility for all use of his account. Customer is solely responsible for maintaining the security of his username and password and is liable for any individual's use of their account. Customer may allow, at their sole discretion, another member of his family or household, including a minor, to use his account subject to their supervision and assumption of all resulting liabilities. Customers may not assign, sell, or transfer their account with IIS without prior written authorization from IIS. No more than one single connection may be established under customer's username at any given time.

IIS allocates system resources in order to provide all customers with the best service possible. As part of resource allocation, IIS may limit, restrict or prioritize access to network and system resources including bandwidth, CPU time, memory, disk space, session length and number of sessions. IIS may impose surcharges for customers who need additional resources. The specifics are defined for each type of account offered by IIS and are detailed in the IIS Pricing Guide and the IIS Billing Policies. Any intentional abuse of idle timeouts in order to maintain an otherwise idle connection is strictly prohibited and is cause for immediate account termination. This termination is solely at the discretion of IIS and / or its employees.

Usage Policy
Customers will not attempt to obstruct, damage, or destroy the hardware, software, or security of any section, part, or whole of IIS's Internet System or Connection. IIS reserves the right to release known information of users involved in violations of system security to the administrators of other sites or networks in order to assist them in resolving security incidents. IIS will also cooperate fully with law enforcement authorities in investigating security violations.

Customer agrees to comply with the rules of any other network to which Customer connects via IIS's network. Customer assumes responsibility for determining whether the traffic it originates will be carried on any other network (including any bridging or backbone networks), and for following the rules of any such network. Rules of such networks typically forbid abusive or foul language, distribution of materials considered pornographic, unsolicited commercial messages, or inappropriate content.

Use of IIS services is strictly for lawful purposes. Transmission of any material in violation of any US federal or state regulation is strictly prohibited. This includes, but is not limited to any information or material provided by copyrighted information, or materials protected by trade secret. Customers will not hold IIS responsible for any claims resulting from use of services which cause damages customer or another party.

Customer agrees that it will not use IIS's network for launching attacks, probes or any security violations of any other networks. Other expressly disallowed usage includes, but is not limited to, "spamming", abusive or foul language, storage of pornographic material, or inappropriate use of newsgroups or any other information distribution device. It is agreed that IIS has the right to investigate activity, in any manner necessary, that may infringe on this Use Policy. Furthermore, IIS will be obliged to make no reimbursement to Customers terminated or suspended for violations of this policy.

Technical Support
IIS will provide technical support expressly intended to establish and maintain connectivity and use of basic Internet activities. We will support any software licensed and distributed by IIS or agents distributing software on our behalf. IIS will also provide the necessary configuration information to allow the use of other software, however, additional support is the responsibility of the software distributor or manufacturer. We make no claim to support any particular software not distributed by IIS or any particular hardware. Any help above and beyond the technical support described herein is solely at the discretion of IIS and its employees.

Disclaimer
IIS makes no warranty of any kind whether expressed or implied for the service it provides. IIS disclaims any warranty of merchantability or fitness of any purpose. IIS will not be responsible for any damages suffered by Customer or inflicted by Customer upon others. This includes loss resulting from delays, nondeliveries, misdeliveries, or service interruptions independent of their causes. Use of any information obtained via IIS is done so at Customer's own risk. Furthermore, IIS specifically denies any responsibility for the accuracy or quality of information obtained through its services. Customer is fully responsible for the privacy of, content of, and liability for, his own communications.

Customer agrees to hold IIS and its employees harmless for direct, incidental, special, or consequential damages of any kind whatsoever arising out of or related to the fact that customer is utilizing IIS for its connectivity to the Internet, and/or other networks, or arising from customer's breach of the terms and conditions of this contract.

Customer acknowledges that no guarantee is given to any minimum amount of continuous bandwidth to Customer's computer. Furthermore, Customer agrees to hold IIS harmless for damages of any kind whatsoever arising from lack of connectivity to the Internet.

IIS and / or its employees reserve the right to deny access and / or terminate access to any individual for any or no reason, at any time. This denial or termination is solely at the discretion of IIS and / or its employees.

IIS reserves full ownership and / or rights to all data and information stored on IIS systems. This full ownership and / or rights includes all files, programs, data, and / or information stored on IIS systems.

Use of Impulse Internet Services and / or software signifies that you have read and accept the terms of this Terms of Service Agreement.

IIS retains the right to alter the terms and conditions of this Contract and will notify Customer of any such changes via email at least 30 days in advance. It is agreed upon that this Contract supersedes all prior written or oral contracts, agreements, and understandings.
